Terms of Service & Privacy Policy

Accessing or using the services means you accept these terms, creating a contractual relationship between you and ENTEK.AI. If you do not agree, you may not obtain or use the services. These terms replace all prior agreements with you. ENTEK.AI may terminate these terms or any of your services at any time for any reason, or suspend/deny access to the services altogether.

Supplementary terms may apply to certain services (e.g., policies for events or promotions). Such terms are part of this Agreement and prevail in case of conflict.

ENTEK.AI may amend these terms periodically; changes take effect upon posting. Continuing to access or use the services after posting means you accept the revised terms.

Personal data is collected and used per ENTEK.AI's Privacy Policy (see https://www.entek.ai). ENTEK.AI may share necessary information including your contact details with third parties in case of complaints, disputes, or legal claims.

The services are a technology platform enabling users of the ENTEK.AI app or website ("Application") to arrange delivery of gas cylinders and/or logistics services with third-party providers, including independent distributors ("External Service Delegates"). The services are for personal, non-commercial use unless ENTEK.AI agrees otherwise in writing. ENTEK.AI itself does not provide transport or logistics services; all such services are supplied by independent delegates who are not ENTEK.AI employees.

Subject to these terms, ENTEK.AI grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to (1) access and use the Application on your personal device solely for the services, and (2) access and use related content and materials for personal not commercial purposes. ENTEK.AI and its licensors reserve all rights not expressly granted.

You may not:

1. Remove any copyright, trademark, or proprietary notices from the services.
2. Reproduce, modify, create derivative works from, distribute, license, lease, sell, resell, transfer, publicly display, publicly perform, broadcast, or exploit the services except as expressly allowed by ENTEK.AI.
3. Decompile, reverse-engineer, or disassemble the services.
4. Link to, mirror, or frame any part of the services.
5. Launch scripts/programs to scrape, index, or extract data, or to impair the services.
6. Attempt unauthorized access to or damage any aspect of the services or related systems/networks.

The services may involve third-party content or services (including ads) beyond ENTEK.AI's control; separate terms and privacy policies may apply. ENTEK.AI does not endorse such content/services and is not liable for them. Apple, Google, Microsoft, and their affiliates are third-party beneficiaries of this contract when you use device-specific apps; they are not parties to this Agreement nor responsible for the services.

By this Agreement, you authorize ENTEK.AI to contract with others (e.g., gas distributors) to deliver orders to your registered address or shared location, and to share your information including location with those parties.

The services and all related rights remain ENTEK.AI's or its licensors' property. These terms give you no rights in the services except the limited licence above, nor any right to use ENTEK.AI's or its licensors' names, logos, or trademarks.

To use most services, create and maintain an active personal account ("Account"). You must be at least 18 (or legal majority in your jurisdiction). Registration requires accurate personal data (name, address, mobile number, age) and at least one valid payment method. Maintain current, accurate information; failure to do so may block access or cause termination. You are responsible for all activity under your account and must keep your username and password confidential. You may not hold more than one account unless ENTEK.AI allows it in writing.

The service is unavailable to persons under 18 or below legal majority. You may not let others use or transfer your account. Use the services legally only; do not cause harm, nuisance, or property damage to external providers or others.

ENTEK.AI may issue promo codes redeemable for credits or benefits subject to additional terms. Promo codes must be used lawfully for their intended audience, cannot be sold or publicized without permission, may be disabled at any time, are not cash, and may expire. ENTEK.AI may withhold or deduct benefits obtained through misuse or fraud.

By creating an account, you agree the services may send informational SMS. Opt-out anytime by emailing [email protected] with the mobile number; opting out may affect service use.

ENTEK.AI may allow you to submit text, audio, or visual content ("User Content"). You retain ownership but grant ENTEK.AI a perpetual, irrevocable, transferable, royalty-free licence (with sublicensing rights) to use, copy, modify, distribute, publicly display/performance, and exploit the content in any format/channel without further notice or payment.

You warrant you own or have rights to your content and that it does not infringe any third-party rights or laws. Do not submit defamatory, hateful, violent, obscene, or illegal content. ENTEK.AI may review or remove user content at its discretion.

You are responsible for data access, charges, and suitable hardware to use the services. ENTEK.AI does not guarantee compatibility and is not liable for Internet or electronic-communication delays.

Using the services may incur charges for subscriptions or specific services. All fees are due immediately; ENTEK.AI processes payment via your chosen method (Visa, MasterCard, etc.) in SAR or other agreed currency, then emails a receipt. Refunds are issued to the original payment method within 30 business days.

ENTEK.AI may set, change, or remove fees at any time. Charges may rise in certain cases (e.g., late-night emergencies). Promotional discounts offered to other users do not affect your charges unless you also receive them.

Payments fully compensate the external provider for services rendered. Except for gas-cylinder deliveries, ENTEK.AI does not designate any portion of your payment as a tip; gratuities are voluntary. After service, you can rate and leave feedback.

A customer may return purchases within 1 day of purchase or exchange them within 1 day, provided goods are unused, in original packaging, and accompanied by the original invoice. Exceptions include gas cylinders, water products, gasoline, or any used items no longer suitable for return/exchange.

Services are provided "as is" and "as available." ENTEK.AI disclaims all express, implied, and statutory warranties not expressly stated here, including merchantability, fitness for a purpose, and non-infringement. ENTEK.AI does not guarantee reliability, timeliness, quality, suitability, availability, uninterrupted service, or error-free operation, nor the safety or ability of external providers. You bear the entire risk of using the services.

ENTEK.AI is not liable for indirect, incidental, special, punitive, or consequential damages (lost profits, data, personal injury, property damage) arising from:

1. Your use or inability to use the services.
2. Any transaction or relationship between you and an external provider even if ENTEK.AI was advised of possible damages.
3. Theft, assault, or any harm by couriers at the delivery location.
4. Absence of an adult male guardian (mahram) during home installation ENTEK.AI forbids installation without one, and the user bears all responsibility.
5. Any fire, leak, or defect related to gas-cylinder installation; no installation warranty exists once the courier leaves.
6. Any matter beyond ENTEK.AI's reasonable control.

Using ENTEK.AI to schedule gas-cylinder deliveries does not make ENTEK.AI liable for transport, goods, or logistics services except as expressly stated. Nothing here limits consumer rights that cannot be excluded by law.

You will indemnify and hold harmless ENTEK.AI, its officers, directors, employees, and agents from all claims, losses, liabilities, and expenses (including legal fees) arising from:

1. Your use of the services or goods obtained through them.
2. Your violation of these terms.
3. ENTEK.AI's use of your User Content.
4. Your violation of any third-party rights, including those of external providers.

Except where stated otherwise, this Agreement is governed by and construed under the laws of the Kingdom of Saudi Arabia. Any dispute or claim relating to this site is subject to Saudi law.

ENTEK.AI may notify you via:

• A general notice about the services,
• Email to your registered address, or
• Written letter to your registered postal address.

You may notify ENTEK.AI at [email protected].

A subscription expires 365 days after purchase unless the website/promotions state otherwise and no balance has been used. After expiry, the financial relationship ends, and you may not claim any amounts paid. You may request a refund during the subscription period if a service was ordered but not fulfilled due to ENTEK.AI's fault.

You may not assign these terms without ENTEK.AI's prior approval. ENTEK.AI may assign them to (1) an affiliate, (2) an acquirer of its shares, business, or assets, or (3) a successor by merger. No joint venture, partnership, employment, or agency relationship arises from this Agreement or service use.

ENTEK.AI does not store personal data or original card numbers, nor share, sell, store, or rent such data to third parties.

If any provision is held unlawful, invalid, or unenforceable, it shall be replaced by a valid provision with similar effect, and the remaining terms remain enforceable. These terms constitute the entire agreement and supersede all previous agreements on the subject. "Including" means "including but not limited to."
