Terms of Service

ENTEK.AI provides a platform that facilitates:

• For Corporate Clients: An AI-powered procurement platform to manage energy needs, reduce costs, track carbon emissions, and connect with verified suppliers.
• For Energy Suppliers: A marketplace to connect with a large base of corporate and individual customers, optimize delivery, and manage sales.
• For Individual Consumers: A mobile application for convenient ordering and delivery of energy products like LPG.

We act as a neutral intermediary and are not a party to the direct transactions between buyers and suppliers, unless explicitly stated.

To access most features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during the registration process.
• Maintain the security of your password and accept all risks of unauthorized access to your account.
• Promptly notify us if you discover or otherwise suspect any security breaches related to the Service.

We reserve the right to suspend or terminate your account if any information provided is found to be inaccurate, not current, or incomplete.

Orders: You are responsible for all orders placed through your account. All orders are subject to acceptance by the Supplier.

Payment: You agree to pay all fees and applicable taxes for purchases you make. We may facilitate payments to Suppliers, but are not responsible for pricing or payment disputes.

Compliance: You agree to comply with all local laws and regulations regarding the purchase, storage, and use of energy products.

Verification: You must undergo our verification process, which may include providing business licenses, certifications, and other documentation.

Listings: You are responsible for the accuracy of your listings, including product descriptions, pricing, and availability.

Fulfillment: You are obligated to fulfill all orders accepted through the platform in a timely and professional manner, adhering to all applicable safety and transportation regulations.

Fees: You agree to pay the commission fees and any other applicable charges for using our platform, as outlined in your Supplier Agreement.

The Services and all materials therein, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, and copyrights (the "Company Content"), are the exclusive property of ENTEK.AI and its licensors. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such intellectual property rights.

Our collection and use of personal information in connection with your access to and use of the Service is described in our Privacy Policy. The platform utilizes AI and data analytics to optimize services; all data is handled in accordance with our Privacy Policy and the Saudi Personal Data Protection Law (PDPL).

The Services are provided on an "as is" and "as available" basis. ENTEK.AI makes no warranties, express or implied, regarding the Services, including but not limited to the quality, safety, or legality of the products provided by Suppliers.

To the fullest extent permitted by applicable law, ENTEK.AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Services; (b) any conduct or content of any third party on the Services; or (c) unauthorized access, use, or alteration of your transmissions or content.

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Riyadh, Saudi Arabia.
